Legislative restrictions in providing state rental housing

According to the Housing Code of the Republic of Belarus, the state rental housing fund is not subject to mass privatization. However, exceptions are provided by presidential decrees:

• Decree No. 38 – allows in-demand specialists to transition from renting to ownership upon meeting certain conditions established by executive committees;

• Decree No. 37 – provides such a transition for military personnel, also with clearly defined requirements;

• Decree No. 344 – permits enterprises or economic associations that build or purchase housing using subsidized loans to transfer housing to employees after loan repayment, with executive committee approval.

Thus, there is currently no mass transfer of state rental housing into private hands; only specific, strictly regulated cases are possible by decision of the head of state.
